Experience

Alison Gibbs is an Associate at Hunt Ortmann and specializes in the areas of employment, commercial, construction and business litigation.

Ms. Gibbs handles a variety of litigation issues including: all facets of employment litigation, with a specialty in defense-based wage and hour litigation and defense-based class actions. Outside the employment context, she handles claims for: breach of fiduciary duty, fraud, false claims, differing site and changed conditions, extra work, delay and disruption, unfair business practices and breach of contract.

She has been part of several trial teams and handles all stages of the litigation process, including pre-litigation settlement, through the appellate stage before California state and federal courts.

Ms. Gibbs represents employers on matters brought within the Division of Labor Standards Enforcement (DLSE).

In addition to handling litigation disputes, Ms. Gibbs regularly counsels employers on various aspects of labor and employment law. She prepares employee handbooks, wage policies, Human Resources manuals, employment contracts, severance contracts, confidentiality, and non-disclosure agreements.

Before shifting her practice to representing employers, Ms. Gibbs represented workers nationwide in wage and hour class and collective actions. This prior experience provides Ms. Gibbs with the unique qualification of being familiar with the strategies of both sides of wage & hour litigation.

Ms. Gibbs also provides seminars and training sessions in guiding employers on how best to comply with often confusing employment regulations and requirements.

Notable Representation

  • Defense of an individual plaintiff wage and hour case brought against a construction management company. Case settled favorably prior to the discovery phase.
  • Defense of a six-figure wage claim brought in the DLSE. Hearing officer issued a defense verdict ruling no wages were owed to the Claimant.
  • Has defended numerous clients in investigations by DLSE for prevailing wage and wage and hour compliance.
